Grey’s Anatomy hunk Eric Dane and wife Rebecca Gayheart are denying they had a three-way sexual escapade with former Miss Teen USA turned Playboy model Kari Ann Peniche. Kari Ann Peniche claims a video of the three romping in the nude was stolen by roommate Mindy McCready and was meant to be private.

The scandal over the so-called Mcsteamy sex tape video reached new heights Tuesday morning. The video shows Eric Dane, wife Rebecca Gayheart and Kari Ann Peniche crawling around naked and playing in a bathtub. Gayheart and Dane’s lawyers say the video is “not a sex tape,” however, and was “simply a private, consensual moment involving a married couple… never intended to be seen by the public.” Yeah, we’re guessing they probably weren’t gunning for national exposure of this particular independent film.
“It is a private tape made for only my clients’ personal use, and nobody has the rights to exploit it,” lawyer Marty Singer said in a press statement. Kari Ann Peniche’s manager David Weintraub told Us Weekly the tape was just “guys having fun, hanging out together. There is no sex involved in this.”
Kari Ann Peniche claims the video, which was stored on her personal computer, was stolen by ex-roommate Mindy McCready. The two appeared together on the TV reality show Celebrity Rehab 3. Peniche claims Mindy McCready stole her hard drive when she moved out after an argument. Peniche has also stated through her reps that she did not have sex with Rebecca Gayheart and/or Eric Dane.
Representatives for Dane, Gayheart, Peniche and McCready reportedly met to discuss the rights to the video and determined it belonged to Eric Dane. All seemed resolved about the not-sex tape until the video surfaced on Gawker.com Monday.
Note to celebrities out there. If you film yourself crawling around nude with playmates while calling each other by fake porn names, you are pretty much guaranteed that someday it is going to come back to bite you. Just say no to video!
